APPELLATE LITIGATION
MRR has long realized that appellate practice calls for skills that are dramatically different from trial practice. MRR’s attorneys include former federal and state judicial law clerks. The firm’s attorneys are actively involved in educating clients and the bar about appellate issues through lectures and articles.
For more than 20 years, MRR’s dedicated appellate practice group has been highly successful. MRR has represented clients in more than 300 cases filed in federal and state appellate courts including all of Ohio’s twelve intermediate appellate courts, the Supreme Court of Ohio, the United States Court of Appeals for the Sixth Circuit and the United States Supreme Court. Working in close cooperation with trial counsel, the appellate practice group provides quality and cost-effective appellate services on all cases.
MRR appellate lawyers not only handle cases in which the firm acted as trial counsel but they are regularly asked to litigate cases handled at trial by other firms. MRR’s appellate attorneys can assume responsibility for the entire appellate process or provide specialized litigation support at any stage of the trial or appellate proceeding. MRR offers comprehensive appellate services that include, drafting amicus curiae (“friend of the court”) briefs on important industry issues and prosecuting or defending original actions (e.g., mandamus, prohibition, procedendo) in appellate courts.
MRR also offers an array of consulting services. We are available to draft dispositive motions, jury instructions, evidentiary motions and post-trial motions. MRR attorneys can review critical trial motions or appellate briefs, organize (and staff) moot courts, act as local counsel to provide insight into state or Sixth Circuit appellate practice and act as oversight counsel for excess carriers.
The practice group’s chair, John McLandrich, has argued more than 100 cases before the federal Court of Appeals for the Sixth Circuit, and has successfully argued before the Supreme Court of Ohio on several occasions. Frank Scialdone, a partner in the practice group, is one of the few Ohio State Bar Association-certified specialists in appellate law.
